Welcome to Glacev ("Company," "we," "us," or "our").
Glacev operates this website and online store, including all related content, information, tools, products, and services (collectively, the "Services"). The Services are hosted and powered by Shopify Inc.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Glacev and govern your access to and use of the Services, as well as the purchase and use of any products offered through the Services.
BY ACCESSING, USING, OR PURCHASING FROM THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW.
If you do not agree to these Terms, do not use the Services.

3. ELIGIBILITY
By using the Services, you represent and warrant that:
You are at least 18 years old
You have the legal capacity to enter into a binding agreement
All information you provide is accurate and current
Purchases are for personal, non-commercial use only, unless expressly authorized in writing by Glacev
We reserve the right to refuse service, cancel orders, or terminate access for violations of these Terms.
You are responsible for all activity conducted under your account.
4. PRODUCT CATEGORY AND INTENDED USE
The Glacev Ice Cap is a wearable gel ice cap designed to be applied to the full head for cold therapy. It covers the temples, forehead, crown, and sides of the head simultaneously. The product is frozen for approximately two hours before use and worn for up to 20 minutes per session. It is drug-free, hands-free, and reusable.
The Glacev Ice Cap is intended solely for personal, at-home use to support general comfort, relaxation, and cold therapy wellness routines.
The product:
Is not intended for clinical, professional, therapeutic, diagnostic, or rehabilitative use
Does not actively alter the structure or function of the body
Does not modify, repair, or restore tissue, bone, organ, or nerve function
Is designed for sessions limited to 20 minutes; sessions must not exceed this duration
Any use of the words "therapy," "treatment," or similar phrasing on supplier spec sheets, third-party product listings, internal product naming conventions, or marketplace descriptions is descriptive of the general consumer wellness category in which the product is sold. Such phrasing does not represent a medical, therapeutic, diagnostic, or clinical claim made by Glacev regarding this product.
5. GENERAL WELLNESS AND NON-MEDICAL DISCLAIMER
The Glacev Ice Cap is a general consumer wellness cold therapy product only.
It is:
NOT a medical device
NOT FDA-cleared, FDA-approved, or FDA-registered medical equipment
NOT intended to diagnose, treat, cure, mitigate, or prevent any disease, injury, or medical condition
NOT a substitute for professional medical care, physical therapy, or licensed healthcare advice
The product has not been evaluated by the U.S. Food and Drug Administration (FDA). No representation is made by Glacev regarding FDA status, clearance, or registration.
The terms "cold therapy" and "cold compress" as used anywhere on the Services are general consumer wellness terms. Their appearance does not imply medical efficacy or any specific health outcome.
Individual experiences vary, and outcomes are not guaranteed.
6. NO MEDICAL ADVICE AND CONTRAINDICATIONS
Information provided through the Services is for general informational purposes only and does not constitute medical advice.
You must consult a licensed healthcare professional before using the product if any of the following apply to you:
You have cold hypersensitivity, cold urticaria, or a known allergy to cold
You have Raynaud's disease or Raynaud's phenomenon
You have cryoglobulinemia or cold agglutinin disease
You have peripheral vascular disease or poor circulation to the head, face, or neck
You are pregnant or may be pregnant
You have open wounds, rashes, broken skin, or recent surgical or procedural sites on or near the head, scalp, face, or neck
You have recently suffered a head injury, concussion, or trauma to the head or neck
You have had recent surgery, procedures, steroid injections, or dermatological treatments on or near the head or face
You have a skin condition that is worsened by cold exposure
You have diabetes with neuropathy or any other condition causing reduced sensation in the head, face, or scalp
You have a clotting disorder or are taking anticoagulant or blood-thinning medication
You have any chronic medical condition or take prescription medication
You have any concern, however minor, about whether the product is appropriate for you
The product is not intended for use on or by:
Children, infants, or anyone under the age of 18
Individuals unable to feel cold, numbness, or pain in the area of application, including those with neuropathy, paralysis, or recent local anesthesia
Persons unable to follow the safety instructions provided
Use of the product is at your sole discretion and risk. If at any point during or after use you experience numbness, tingling, pain, skin color changes (extreme redness, whitening, or bluish discoloration), burning sensation, dizziness, headache, or any other adverse reaction, discontinue use immediately and consult a healthcare professional.
7. MATERIALS AND SKIN CONTACT
The Glacev Ice Cap consists of a gel-filled therapeutic pack encased in a soft fabric outer shell with an adjustable closure. The gel and fabric materials are widely used in consumer cold therapy products, but individual sensitivities may vary.
By using the product, you acknowledge and agree that:
Skin irritation, redness, or sensitivity may occur
Do not use the product if the gel pack is visibly damaged, punctured, or leaking
Do not apply to broken, inflamed, sunburned, irritated, or recently treated skin
A thin cloth barrier may be used if direct cold contact causes excessive discomfort
Discontinue use immediately if skin becomes numb, excessively red, pale, or bluish
Maximum session length is 20 minutes; do not exceed this limit
Allow the skin to return to normal temperature before beginning a second application
The product is not designed for laundering as a typical garment; follow the cleaning instructions provided with the product
You assume full responsibility for any skin reactions or sensitivities.
8. CHEMICALS AND MATERIAL COMPLIANCE
The Glacev Ice Cap is designed for consumer use and is sourced from third-party manufacturers.
The gel pack contents are non-toxic consumer-grade materials. We do not intentionally add BPA, phthalates, or other restricted substances to our products. However, we rely on supplier-provided material information and manufacturing processes.
Any certifications, test reports, or compliance representations relating to the materials or assembly of the product originate from the supplier or manufacturer and are supplier representations only. They are not independent compliance attestations made by Glacev.
No representation or warranty is made by Glacev that the product is free from all trace chemicals under all possible conditions of use.
If required by applicable law (including but not limited to California Proposition 65), appropriate warnings will be provided on the product packaging or product page.
9. COLD THERAPY SAFETY
By purchasing or using the product, you acknowledge and agree to the following safety requirements.
Cold exposure safety:
Maximum wear time is 20 minutes per session; do not exceed this limit
Do not apply the product to areas of reduced or absent sensation, including neuropathy, paralysis, or skin that has been recently anesthetized, due to the risk of unnoticed cold injury
The product is designed to be worn over its fabric shell; do not apply the gel pack directly against bare skin if the gel has been frozen to an extreme temperature
Do not use on broken, inflamed, sunburned, or recently treated skin
Do not place the product directly over the eyes or eyelids
Discontinue use immediately if you experience numbness, pain, burning, skin whitening, bluish discoloration, or unusual color changes to the skin — these may indicate cold injury (frostbite); seek medical attention if symptoms persist
Gel pack safety:
Inspect the gel pack before each use; do not use if the packaging is damaged, punctured, or leaking
Gel pack contents are non-toxic but are not intended for ingestion; keep the product away from children and pets
Do not heat the gel pack in a microwave or oven; the product is intended for cold therapy only
Freeze according to the instructions provided; do not expose the gel pack to temperatures below those stated in the product documentation
Storage and handling:
Store the product in a clean, sealed bag in the freezer when not in use
For hygiene reasons, do not share the product between users
Do not run consecutive sessions on the same area without allowing the skin and tissue to return to normal temperature
You agree to follow all instructions and safety guidelines provided with the product and on the Services.
10. ASSUMPTION OF RISK
You voluntarily assume all risks associated with the use or misuse of the product, including but not limited to:
Cold-induced numbness, tingling, or skin discomfort
Frostbite or cold injury from prolonged, improperly positioned, or unmonitored application
Cold hypersensitivity reactions, including cold urticaria or vasospasm in susceptible individuals
Skin redness, irritation, or sensitivity from cold contact
Circulatory reactions in individuals with vascular conditions
Improper fit, excessive session duration, or failure to follow provided instructions, contraindications, or safety warnings
11. PRODUCT PRESENTATION DISCLAIMER
Product images, videos, descriptions, testimonials, and marketing materials are for illustrative purposes only.
Actual product appearance, materials, packaging, or performance may vary.
Testimonials reflect individual experiences and do not guarantee results.
We reserve the right to modify or discontinue products at any time without notice.
12. ORDERS AND BILLING
All orders constitute an offer to purchase and may be accepted or rejected at our discretion.
Orders generally cannot be modified or canceled once placed.
You authorize us to charge your selected payment method for all amounts due.
We reserve the right to cancel orders suspected of fraud, abuse, or unauthorized resale.
13. SHIPPING AND INTERNATIONAL FULFILLMENT
Orders ship directly from international fulfillment partners, primarily located in China, to the customer in the United States. Goods do not transit through Germany at any point.
Glacev does not maintain warehousing, retail, or fulfillment operations in either the United States or Germany.
You acknowledge that:
Delivery times are estimates, not guarantees
Delays due to customs or carriers may occur
Accurate shipping information is your responsibility
Orders marked as delivered by the carrier are considered fulfilled
14. RETURNS AND PAYMENT DISPUTES
Returns and refunds are governed by our Refund Policy, including the 30-day satisfaction guarantee.
We reserve the right to contest improper chargebacks or abusive dispute behavior.
Customers engaging in excessive or fraudulent disputes may be refused future service.
15. USER CONTENT LICENSE
By submitting reviews, images, videos, or other content, you grant Glacev a perpetual, worldwide, royalty-free, irrevocable license to use such content for marketing, promotional, and business purposes.
16. INTELLECTUAL PROPERTY
All content on the Services is owned by Glacev or its licensors and protected by intellectual property laws.
Unauthorized use is prohibited.
17. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
18. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OR MISUSE OF THE PRODUCT.
19. INDEMNIFICATION
You agree to indemnify and hold Glacev harmless from any claims, damages, or expenses arising from misuse of the product or violation of these Terms.
20. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration, you agree to contact support@glacev.com and allow 30 days for informal resolution.
21. ARBITRATION AND CLASS ACTION WAIVER
Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis
No class actions or representative claims
Arbitration may take place remotely or in New York, New York
Small claims court remains permitted
Opt-Out: You may opt out within 30 days of purchase by emailing support@glacev.com with your full name and order number.
22. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and without depriving consumers of mandatory rights under applicable consumer protection laws, including those of their state of residence.
23. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically.
24. FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control.
25. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is deemed invalid, the remaining provisions remain enforceable.
These Terms constitute the entire agreement between you and Glacev.
